1. Acceptance of Terms
By accessing or using PropertyGenome ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. These terms apply to all users, including Free, Homeowner, Agent, Plus, Pro, and Enterprise subscribers.
Age Requirement: You must be at least 18 years of age to create an account or use the Service. By registering, you represent and warrant that you are 18 or older. The Service is not directed at or intended for minors under 18. If we become aware that a user is under 18, we will promptly terminate their account and delete any associated data in accordance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.
PropertyGenome reserves the right to update these terms at any time. Material changes will be communicated via email or in-product notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.
2. Service Description
PropertyGenome provides real estate analysis tools including Genome Score, property scoring, comparable sales context, undervalued home discovery, investment calculators, a Deal Tracker, skip tracing, outreach tools, and related investor workflow features ("the Service").
The Service is provided for informational and decision-support purposes only. PropertyGenome does not provide investment, financial, tax, legal, or appraisal advice. All outputs — including Genome Score, valuations, deal ratings, and market signals — are estimates based on algorithmic models and third-party data, not professional appraisals or investment recommendations.
3. No Financial or Investment Advice
IMPORTANT: PropertyGenome is NOT a registered investment adviser, broker-dealer, or financial planner under the Investment Advisers Act of 1940 or any state equivalent.
Nothing on the platform constitutes investment advice, a recommendation to buy or sell any property, or a guarantee of investment returns. Deal ratings, Genome Scores, and calculator outputs are algorithmic estimates for comparison purposes only. They do not account for your personal financial situation, risk tolerance, investment goals, or local market conditions.
You acknowledge that real estate investments involve significant risk, including risk of loss. PropertyGenome is not responsible for any investment losses or decisions made based on platform outputs. Always consult a licensed real estate professional, CPA, financial advisor, or attorney before making investment decisions.
4. Skip Trace & Contact Data Terms
If you use the skip trace feature, you agree to the following conditions:
(a) Permissible Purpose: You confirm you have a lawful permissible purpose under the Fair Credit Reporting Act (FCRA) and the Driver's Privacy Protection Act (DPPA) to retrieve contact information. Permissible purposes include, but are not limited to, a legitimate business transaction or investment inquiry.
(b) Prohibited Uses: You may NOT use skip trace results for credit decisions, employment screening, insurance eligibility, tenant screening, stalking, harassment, or any other purpose prohibited by FCRA, DPPA, or applicable law.
(c) Compliance Responsibility: You are solely responsible for your use of contact data, including compliance with FCRA, DPPA, TCPA, state "do not call" registries, and any other applicable laws.
(d) No Warranty: PropertyGenome makes no warranty regarding the accuracy, completeness, or currency of skip trace results. Results are sourced from third-party providers and may be outdated or incorrect.
5. Outreach, SMS, & RVM Terms
If you use SMS, ringless voicemail (RVM), email outreach, or drip campaign features:
(a) TCPA Compliance: You are solely responsible for obtaining prior express written consent from all recipients before sending marketing or solicitation text messages or ringless voicemails, as required by the Telephone Consumer Protection Act (TCPA). Violations of TCPA carry statutory damages of $500–$1,500 per message.
(b) Opt-Out: You must honor all opt-out requests promptly and provide clear opt-out instructions in every outreach message (e.g., "Reply STOP to unsubscribe").
(c) CAN-SPAM: Commercial emails must comply with the CAN-SPAM Act, including valid physical address and opt-out mechanisms.
(d) Indemnification: You agree to indemnify, defend, and hold harmless PropertyGenome from any claims, damages, or penalties arising from your use of outreach tools, including TCPA or CAN-SPAM violations.
6. Data Accuracy & Disclaimer
PropertyGenome's data comes from third-party providers (LightBox, ATTOM, RentCast, USPS, and others), user inputs, and county records where available. We do not guarantee:
• The accuracy, completeness, or timeliness of any property data, valuation estimate, or parcel record
• That Genome Scores accurately predict property value or investment performance
• That comparable sales data reflects current market conditions
• That undervalued home detection identifies properties that will appreciate in value
Missing or incomplete data should not be interpreted as definitive property information. Always verify property facts through official county records, licensed appraisers, or title companies before transacting.
7. Acceptable Use
You agree NOT to:
• Use the Service to engage in illegal activities, fraud, or harassment
• Scrape, bulk-download, or systematically extract data from the platform
• Resell, redistribute, or sublicense data obtained from the Service to third parties
• Reverse-engineer, decompile, or copy any part of the platform
• Use skip trace results to stalk, harass, or intimidate any person
• Violate the terms of service of any third-party data provider
• Attempt to circumvent subscription tier limits, access controls, or rate limits
• Impersonate any person or entity, or falsely claim affiliation with PropertyGenome
8. Subscription & Billing
Paid plans (Agent at $29/month, Plus at $49/month, Pro at $129/month, Enterprise starting at $399/month) are billed through Stripe. The Homeowner plan is free. By subscribing, you authorize PropertyGenome to charge your payment method on a recurring basis until cancelled.
Auto-Renewal Disclosure: Subscriptions automatically renew at the end of each billing period. Your payment method will be charged the applicable plan price unless you cancel before the renewal date.
How to Cancel: You may cancel your subscription at any time by visiting Account → Billing in the app and clicking "Cancel Plan," or by emailing [email protected] with your account email. Cancellation takes effect at the end of the current billing period; you retain full access until that date. You will receive a cancellation confirmation email within 24 hours.
Refund Policy: We offer a full refund within 7 days of your initial subscription if you have not used any paid features (skip traces, outreach deliveries, RVM drops, or direct mail). After the 7-day window, refunds are not issued for partial billing periods. If you believe you were charged in error, contact [email protected] within 30 days of the charge.
Price Changes: PropertyGenome may modify pricing with 30 days' written notice via email and in-product banner. Continued use after the notice period constitutes acceptance of the new pricing.
Enterprise terms are governed by separate written agreements.
9. Intellectual Property
All platform software, design, branding, Genome Score methodology, and content are the property of PropertyGenome and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without express written permission.
"PropertyGenome," "Genome Score," and related marks are proprietary. Third-party trademarks and data used within the platform (LightBox, ATTOM, RentCast, Mapbox, Stripe, etc.) are the property of their respective owners.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTYGENOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE SERVICE.
PROPERTYGENOME'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PROPERTYGENOME IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless PropertyGenome, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your use of skip trace or outreach features in violation of applicable law; or (d) your infringement of any third-party rights.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, or in the state or federal courts located in Charlotte, North Carolina, at PropertyGenome's election.
CLASS ACTION WAIVER: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PROPERTYGENOME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this Class Action Waiver is found unenforceable, the arbitration clause in its entirety shall be null and void.
JURY TRIAL WAIVER: BY AGREEING TO THESE TERMS, YOU AND PROPERTYGENOME EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE ARISING UNDER THESE TERMS OR YOUR USE OF THE SERVICE.
13. Force Majeure
PropertyGenome shall not be liable for any failure or delay in performance of obligations under these Terms to the extent caused by events beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government action or regulation, embargoes, strikes, power failures, internet outages, third-party service provider outages (including cloud infrastructure, payment processors, and API providers), or cyberattacks.
In the event of a force majeure, PropertyGenome will notify users as soon as practicable and resume normal service as quickly as reasonably possible. Pro-rated refunds for extended outages (greater than 72 consecutive hours) may be issued at PropertyGenome's discretion.
Service Availability: PropertyGenome does not warrant that the Service will be available at all times or without interruption. Scheduled maintenance windows will be announced in advance where possible.
14. Export Control & Sanctions Compliance
The Service may be subject to U.S. export control laws, including the Export Administration Regulations (EAR, 15 C.F.R. Parts 730-774), and economic sanctions administered by the U.S. Office of Foreign Assets Control (OFAC).
By using the Service, you represent and warrant that:
(a) You are not located in, and are not a national or resident of, any country subject to a U.S. government embargo or designated as a "terrorist-supporting" country;
(b) You are not listed on OFAC's Specially Designated Nationals (SDN) list, the BIS Denied Persons List, or any other U.S. government restricted-party list;
(c) You will not use the Service to export, re-export, or transfer data or technology in violation of applicable export control laws or regulations.
PropertyGenome reserves the right to suspend or terminate access to users who violate this section.
15. Copyright & DMCA
PropertyGenome respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Takedown Notice Requirements (17 U.S.C. § 512(c)(3)):
To file a valid takedown notice, your written notification must include:
(a) A physical or electronic signature of the copyright owner or authorized agent;
(b) Identification of the copyrighted work claimed to have been infringed;
(c) Identification of the material to be removed and information sufficient to locate it on the Service;
(d) Your contact information (address, telephone number, email);
(e) A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
(f) A statement that the information is accurate and, under penalty of perjury, that you are authorized to act.
Counter-Notice (17 U.S.C. § 512(g)):
If your content was removed in error, you may file a counter-notice with the DMCA Agent containing: (a) your signature, (b) identification of the removed material, (c) a statement under penalty of perjury that the material was removed by mistake or misidentification, and (d) your consent to federal court jurisdiction in the district where you reside.
Repeat Infringer Policy:
PropertyGenome will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights.
